Terms and Conditions.

Bidding

All bids made through the Web site are legally binding and cannot be withdrawn once placed.

All bids are exclusive of applicable VAT which shall be additionally payable.

With the exception of “Buy Out” auctions, each lot will be sold to the highest bidder at the end of the auction. The time of the end of the bidding is clearly shown on the Web Site.

In the event of a dispute arising over a lot the dispute will be resolved in such a manner as the Web Site may determine in its absolute discretion.

If you are outbid by a higher bid, which is subsequently removed for whatever reason, the Web Site reserves the right to accept another bid made.

Upon conclusion of a successful bid:

- A binding legal contract shall exist between the bidder and the seller for the sale of the goods the subject of the bid.

- The bidders shall collect the goods within 14 days unless otherwise arranged by agreement with the seller.

- The bidder shall pay for the goods within 14 days including applicable VAT.

- For non-account members,

o the seller shall become liable to pay for any sale item “feature and additional photo fees” immediately through PayPal before insertion of the sale item is accepted.

o On sale completion(s) payment must be made to the Web Site in respect of sale commission An electronic invoice shall be made available to the seller by the Web Site. The commission shall be payable regardless of whether the sale and purchase of the goods is completed.

- For account members,

o Payment of fees if applicable will be suspended until either sale completion (whole or part e.g. Dutch Auctions) or the item is removed from the auction.

o On sale completion, ConstructionResale Ltd will raise an invoice for commission and any fees unpaid relating to that sale.

o Funds for invoice payments must be cleared through the ConstructionResale bank account by the last day of the month following invoice date. Please note the system will automatically freeze all outstanding auctions if these terms are not met.

- Payment can be made through PayPal, by Internet Banking or by BACS transfer to the Web Site bank at:

General Terms

This Web site is intended to be a friendly and enjoyable experience but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand these terms before joining. If you spot a listing you feel is violating the general terms and conditions of this Web Site as stated below please let us know by contacting us.

Right to Suspend or Terminate.

You agree that this Web-Site in its own discretion may terminate any auction or use of the service immediately and without notice if a) we believe that you are not abiding by the general rules of this Web Site b) your have repeatedly broken a certain term c) you have listed as suspicious item d) we believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Your conduct.

You are solely responsible for the contents of your actions through this Web Site. You must ensure that your participation in the selling or buying of items does not violate and you must comply with any applicable laws or regulations. By this we mean that you must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.

Membership.

Membership to this Web Site is only available to business buyers and sellers who can form a legally binding contact. This Web Site dose not permit minors (under 18) to register. If any member fails to sign up with their correct age the account will be terminated immediately.

Liability

This Web Site acts as the window for sellers to conduct auctions and for bidders to bid on seller’s auctions. Goods are sold as seen or as described. The Web Site does act as auctioneer and is not involved in the actual transaction between buyers and sellers. As a result it has not control over the quality, safety or legality of the items listed or the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. The Web Site cannot and does not control whether or not sellers complete the sale of the items they offer or buyers will complete the purchase of items they have bid on. In addition, note that there are risks in dealing with foreign nationals, underage persons or persons acting under false pretence.

To the fullest extent permitted by law this Web-Site shall not be responsible for any items sold by auction, for any damage to items during transit or during the inspection period, nor for misrepresentation and/or breaches of contract by either buyer and/or seller. This Web Site shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained. This Web Site assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as reasonably possible.

Notwithstanding the above any liability of the Web Site is limited in relation to a concluded transaction to the total fees received from the seller in any twelve-month period or in any other case to £100.

Law.

These Terms and Conditions shall be governed by English law and be subject to the exclusive jurisdiction of the English courts.

No party other than the bidder(s), seller(s) or the Web Site shall have and rights under the Web Site agreement.
